Price Promise must be read subject to these Terms.
Harvey Norman stores are operated by independent franchisees (“franchisee”) pursuant to franchises granted by subsidiaries of Harvey Norman Holdings Limited ACN 003 237 545.
To be eligible for Price Promise you must purchase and pay for in full a product from a franchisee. Within thirty (30) days after the date of purchase, you must have found a bona fide advertised price for an identical product (including supplier and model no.) in a daily newspaper or catalogue or on commercial radio or television (photographs will not be accepted) and delivered copies and/or evidence to the franchisee. Application for claims for the Price Promise can only be accepted by the franchisee where you made your purchase.
The identical product must be a lower price (“lower price”) than the price you paid for the product after all allowances, rebates and discounts (“Harvey Norman Price”) and advertised and available for sale by a local retail competitor actively engaged in the franchisee’s local retail market (“competitor”) during the period thirty (30) days after the date of purchase. The franchisee reserves the right to verify the evidence of the identical product sold at the lower price.
If your claim qualifies for the Price Promise, the franchisee will, within fourteen (14) days of approval, pay an amount equivalent to 110% of the difference between the lower price and the Harvey Norman Price. The amount will be refunded in the same manner of tender as the original purchase. A refund will be made for each product in an invoice which qualifies for Price Promise.
Price Promise does not apply where:
the lower price is conditional, or a price determined after the allowance of any amount for, or is part of a promotion involving, financing, installation, delivery, rebates, cash back offer, free or bonus offer, trade discount, stock clearance or any limited quantity promotion; or
the lower price is offered under any promotion with a third party (including, but not limited to, promotions with newspapers, exhibitions or other special events); or
a competitor advertises the product at the lower price in store only; or
the lower price is not available to the general public; or
the identical product is advertised in classifieds, online retailers, fire or liquidation sales, rack, clearance and warehouse outlets; or
the lower price has been discounted by the competitor by use of coupons, loyalty rewards, redemption of frequent flyer miles or similar and other offers or incentives to reduce the total cost; or
the lower price has been discounted by the competitor on the basis that the product is floor stock, end of line, ex demo, second hand or similar; or
the difference in cost between the Harvey Norman Price and the lower price is the result of an error by the competitor; or
the franchisee is unable to verify, using reasonable means, that the lower price is available;
you have exercised your right to a refund before you apply for a Price Promise; or
you utilise the photo centre services for photo processing and other related services.
The refund of the 110% difference between the Harvey Norman Price and the lower price is the sole and exclusive compensation that will be payable to you if you show the franchisee did not meet its Price Promise.
This Price Promise may be terminated or amended at any time without notice.
The Price Promise is subject to you complying with the franchisees usual terms and conditions of trade.
The information you provide to the franchisee will only be used to provide the Price Promise refund to you or to discuss with you your Price Promise claim. A copy of the franchisee’s privacy policy is available in store.
